Privacy is very important
to us. Our privacy practices are held to high standards
and designed to build users' trust and confidence in the
Internet. Because this web site wants to demonstrate its
commitment to your privacy, it has agreed to disclose
its information practices. As part of the normal operation
of our services we collect and, in some cases, disclose
information about you. This Privacy Policy describes the
information we collect about you and what may happen to
that information. Although this policy may seem long,
we have prepared a detailed policy because we believe
you should know as much as possible about PathLight's
practices so that you can make informed decisions. The
privacy practices of this statement apply to the http://mypathlight.com
website and apply generally to our subsidiaries or joint
venture partners and marketing partners websites (collectively
the "Site").
As described below, some of your personally identifiable information
is disclosed to third parties and used by us and third parties.
By accepting the User Agreement, you expressly consent to
our use and disclosure of your personally identifiable information.
This Privacy Policy is incorporated into and subject to the
terms of the PathLight Master User Agreement.
PathLight is committed to honoring the privacy of
our members and visitors. This privacy policy, part of
our overall Terms of Service covers personally identifiable
information shared through PathLight's Service.
As a matter of policy, we do not sell or rent any personally
identifiable information about you to any third party. However,
the following describes some of the ways that your personally
identifiable information may be disclosed.
If you feel that this company is
not abiding by its posted privacy policy, you should first
contact Byte Size Tools, LLC at 1-800-540- PATH, write
to: PathLight, C/O Byte Size Tools, LLC, 787 E. Hickory
Hill Road, Argyle, Texas 76226 or email: privacy@mypathlight.com.
What information does PathLight receive
and how do we use it? When you register for PathLight
or various PathLight services, we ask you for your name, contact
information, preferences, and certain demographic information.
This information lets us provide personalized services and
communicate separately with you. We also use aggregated information
about the use of our services to evaluate our users' preferences,
improve our programming, and facilitate third-party reporting
of internet usage. Finally, like most websites, we use small
bits of data called cookies stored on users' computers to
simulate a continuous connection. Cookies let us "remember"
information about your preferences and allow you to move within
our Service without reintroducing yourself. Recent versions
of PathLight's browsers let you easily see and control cookies.
Specifically, PathLight gathers "Registration
Information" when you open an account which includes,
but not limited to: Your name, address, company,
city, state, zip code, country, phone number, fax number,
email address gender, your password, credit card number and
expiration date and other financial information and optional
demographic information such as hobbies, etc. PathLight
does NOT release any user information in the PathLight account
("User Information") to any third parties.
Do You use my information that I input
and is personal and unique to me? No. This information,
such data you input that is stored and protected via your
User Name,/User ID and Password ("User Information"),
for example, phone numbers of friends, bank account numbers,
etc., for your use in PathLight is NOT disclosed to any third
party.
May I choose what information I disclose? While we need certain
information to register you as a unique user and let you access
personalized services, such as PathLight other requested information
is optional and may be given at your discretion.
May I choose what communications I
receive? We may choose to occasionally send out an
email newsletter to PathLight members to highlight features
of the Service. You can elect not to receive the Newsletter
from us, either when you register or by noting your preference
in response to communications from us.
Users who no longer wish to receive our newsletter or promotional
materials from PathLight or our partners may opt-out of receiving
these communications by replying to unsubscribe in the subject
line in the email or email us at support@mypathlight.com.
Users of our site are always notified when their information
is being collected by any outside parties. We do this so
our users can make an informed choice as to whether they
should proceed with services that require an outside party,
or not.
What about Special Offers, Site and Service
Updates?
We send all new members a welcoming email to verify password
and username. Established members will occasionally receive
information on PathLight-specific products, services, special
deals, and a newsletter.
We also send the user site and service announcement updates.
Members are not able to un-subscribe from service announcements,
or special offer announcements, which contain important
information about the existing or new service. We communicate
with the user to provide requested services and in regards
to issues relating to their account via email or phone.
These communications include, but are not limited to, such
items as billing information, upcoming expiration dates
on credit cards used for PathLight Service payments or other
account information.
What is the PathLight Tell-A-Friend
program and how does it affect me?
If a user elects to use our referral service for informing
a friend about our site, we ask them for the friend's name
and email address. PathLight will automatically send the friend
a one-time email inviting them to visit the site. PathLight
stores this information for the sole purpose of sending this
one-time email. The friend may contact PathLight at http://www.mypathlight.com
to request the removal of this information from their database.
What if I need to review or change
the personal information I previously disclosed? We
encourage PathLight members to update and edit their personal
information and keep it current. Following registration, you
can review and change the information you submitted during
registration. If you desire to change your User ID you may
make this request by sending an email to privacy@mypathlight.com.
or by calling 1-800-540- PATH. Such information will be deactivated
as soon as reasonably possible in accordance with our deactivation
policy and applicable law.
We will retain in our files information you have requested
to remove in some circumstances, such as to resolve disputes,
troubleshoot problems and enforce our User Agreement. Further,
such prior information is never completely removed from
our databases due to technical and legal constraints, including
stored "back up" systems. Therefore, you should
not expect that all of your personally identifiable information
would be completely removed from our databases in response
to your requests.
What kind of security is used to protect
my information? We store all user information in secure
databases protected via a variety of access controls. This
data is accessed only for the purposes specified in this privacy
statement. PathLight uses industry standard practices to safeguard
the confidentiality of your personal identifiable information,
including "firewalls" and Secure Socket Layers.
PathLight treats data as an asset that must be protected against
loss and unauthorized access. We employ many different security
techniques to protect such data from unauthorized access by
users inside and outside the company. However, "perfect
security" does not exist on the Internet.
Who has access to my information? We do not share personally
identifiable data (Registration Data) with other companies
(apart from those acting as our agents in providing our Service
to you, who agree to use it only for that purpose). We use
information in the file we maintain about you, and other information
we obtain from your current and past activities on the Site,
to resolve disputes, troubleshoot problems and enforce our
User Agreement. At times, we may look across multiple users
to identify problems or resolve disputes. You agree that we
may use personally identifiable information about you to improve
our marketing and promotional efforts, to analyze site usage,
improve our content and product offerings, and customize our
site's content, layout, and services. These uses improve our
site and better tailor it to meet your needs.
You agree that we may use your information to contact you
and deliver information to you that, in some cases, are targeted
to your interests, such as administrative notices, product
offerings, and communications relevant to your use of the
Site. By accepting the User Agreement and Privacy Policy,
you expressly agree to receive this information. If you do
not wish to receive these communications, we encourage you
to opt out of the receipt of certain communications on the
notification preferences page. You may make changes to your
notification preferences at any time.
Our Disclosure of Your Information
We Gather When You Register?
Due to the existing regulatory environment, we cannot ensure
that all of your private communications and other personally
identifiable information will never be disclosed in ways
not otherwise described in this Privacy Policy. By way of
example (without limiting the foregoing), we may be forced
to disclose information to the government or third parties
under certain circumstances, third parties may unlawfully
intercept or access transmissions or private communications.
Therefore, although we use industry standard practices to
protect your privacy, we do not promise, and you should
not expect, that your personally identifiable information
or private communications will always remain private.
As a matter of policy, we do not sell or rent any personally
identifiable information about you to any third party. However,
the following describes some of the ways that your personally
identifiable information may be disclosed.
External Service Providers.
There are a number of services offered by external service
providers that help you use our Site (e.g., co-branded sites,
listing agents, escrow, authentication, mediation). If you
choose to use these optional services, disclose information
to the external service providers, and/or grant them permission
to collect information about you, then their use of your information
is governed by their privacy policy. We may, for your convenience,
provide some of your personally identifiable information to
the external service provider offering such services. However,
before we disclose your personally identifiable information
to an external service provider, you will see what data is
about to be sent and have the ability to approve the disclosure.
To prevent our disclosure of your personally identifiable
information to an external service provider, you can decline
such disclosures or simply not use their services. Because
we do not control the privacy practices of these third parties,
you should evaluate their practices before deciding to use
their services. Users who register on a PathLight co-branded
web site grant PathLight permission to pass your email address
back to that co-branded web site and affiliated web sites.
The use of such information by the co-brand and affiliated
web sites is limited by their applicable privacy policies.
Internal Service Providers.
We may use internal service providers to facilitate our services
(e.g., search, discussion boards, surveys) and therefore we
may provide some of your personally identifiable information
directly to them. In some instances, the internal service
provider may collect information directly from you (such as
the situation where we ask a internal service provider to
conduct a survey for us). In these cases, you will be notified
of the involvement of the internal service provider, and all
information disclosures you make will be strictly optional.
In all cases, these internal service providers' use of information
we supply them is restricted by confidentiality agreements.
If you provide additional information to an internal service
provider directly, then their use of your information is governed
by their applicable privacy policy.
Other Corporate Entities. We
share much of our data, including personally identifiable
information about you, with our subsidiaries and joint ventures
that are committed to serving your online application software
needs and related services, throughout the world. To the extent
that these entities have access to your information, they
will treat it at least as protectively as they treat information
they obtain from their other users. Our subsidiaries and joint
ventures follow privacy practices no less protective of all
users than our practices described in this document, to the
extent allowed by applicable law. It is possible that PathLight,
its subsidiaries, its joint ventures, or any combination of
such, could merge with or be acquired by another business
entity. Should such a combination occur, you should expect
that PathLight would share some or all of your information
in order to continue to provide the service. You will receive
notice of such event and we will require that the new combined
entity follow the practices disclosed in this Privacy Policy.
Legal Requests. PathLight cooperates
with law enforcement inquiries, as well as other third parties
to enforce laws, such as: intellectual property rights, fraud
and other rights. We can (and you authorize us to) disclose
any information about you to law enforcement or other government
officials as we, in our sole discretion, believe necessary
or appropriate, in connection with an investigation of fraud,
intellectual property infringements, or other activity that
is illegal or may expose us or you to legal liability. Further,
we can (and you authorize us to) disclose your User ID, name,
street address, city, state, zip code, country, phone number,
email, and company name to PathLight participants as we in
our sole discretion believe necessary or appropriate in connection
with an investigation of fraud, or violation of local, state
or federal laws and statutes.
What about other companies featured
on PathLight? You may separately agree to provide your
information to other companies who provide content for various
parts of our Service, in order to use their services, order
their products, or receive offers from them. If you agree
to provide information to these companies, that information
will be subject to their privacy policies.
What about people using my PathLight
User Id or password?
You are responsible for all actions taken with your User ID/User
Name and password. Therefore we do not recommend that you
disclose your PathLight password to any third parties. If
you choose to share your User ID and password or your information
with third parties to provide you additional services, you
are responsible for all actions taken with your User ID and
password and therefore you should review that third party's
privacy policy. If you lose control of your password, you
may lose substantial control over your personally identifiable
information and may be subject to legally binding actions
taken on your behalf. Therefore, if your password has been
compromised for any reason, you should immediately change
your password. You may call 1-800-540-PATH or email:administrator@mypathlight.com
to change your password or User ID/User Name.
What about children's information?
Children may not contract as a Master User for PathLight,
but the Master User may grant a Sub-User license to a child
and the child is allowed to provide personally identifiable
information at registration. In the case of a child as a Sub-User,
all terms of this Privacy Agreement and Master Use Agreement
will apply to that child. The Master User granting the Sub-user
license to a child must be 18 years old to contract with PathLight.
For questions about kids' privacy or other issues at PathLight,
please email privacy@mypathlight.com.
Who can I contact if I have any questions regarding my
privacy? Please contact us directly at privacy@myPathLight.com
with any questions or comments. For general information
regarding privacy you can visit BBB Online
or the Federal Trade Commission.
What About Changes in PathLight Privacy Polices and Notice.
We may change this Privacy Policy from time to time based
on your comments and our need to accurately reflect our
data collection and disclosure practices. All changes to
this policy are effective after we provide you with at least
thirty (30) days' notice of the changes by posting the changes
on the announcements board and sending email to users who
select such notification preference. We provide you with
thirty (30) days notice to allow you the opportunity to
notify PathLight if you do not agree to such changes. If
at any point we decide to use personally identifiable information
in a manner different from that stated at the time it was
collected, we will notify users by way of an email. Users
will have a choice as to whether or not we use their information
in this different manner. We will use information in accordance
with the privacy policy under which the information was
collected.
